User Agreement for the Internet Service proxystores.com
This User Agreement (hereinafter referred to as the Agreement) is offered by the Administration of the Internet Service proxystores.com to any individual, hereinafter referred to as the User, to order services provided by the Administration on the pages of the proxystores.com Service. The services refer to the possibility for the User to place an order and make payment for the use of proxy address(es) from the list and at the price specified on the Service’s pages, including in the User’s personal account. Any actions carried out by the Administration and Users within the framework of the Internet Service are governed by this Agreement, the Privacy Policy, the Service Rules, as well as applicable laws and generally accepted norms on the Internet. This Agreement is recognized as an offer, i.e., “…contains all essential terms of the Agreement, from which the intention of the person making the offer to conclude the Agreement on the specified terms with any person who accepts the offer in accordance with the terms of this Agreement is evident…”. The unconditional acceptance (acceptance) of the terms of this offer is considered to be the beginning of using the Service to the extent available without registration and/or registration in the Service as a User. The use of the Service by the User means that the User accepts and agrees to comply with all the conditions set forth in this Agreement. This Agreement regulates the procedure for providing services by the Administration using the functional capabilities of the Service and its software. The User accepts and agrees to the condition that the acceptance of this Agreement is a legal fact of consent and acceptance of both the terms of this Agreement and all its appendices, which are integral parts of it. The appendices to this Agreement may have an additional mechanism for their approval and acceptance by the User, which is regulated directly in the text of such an appendix.
Terms and Definitions
- The Internet Service (hereinafter referred to as the Service, Internet Service) is a public online resource published on the Internet at the address proxystores.com, which contains informational materials related to the terms and conditions of contractual relationships between the Administration and the User, including the use of the Service’s services.
- The Administration – the representative of the Service who provides services to the User in the field of offering access to proxy addresses, which are made available by the Administration.
- User – any individual who has completed the registration process and subsequently places an order and makes payment for the services of the Service in accordance with the terms and methods specified in this Agreement.
- Proxy address – a proxy address refers to an intermediary server in computer networks that acts as a mediator between the user and the target server.

General provisions.
- This Agreement governs the relationships that arise between the Administration and Users in the process of providing services by the Administration upon the User’s request in the field of providing proxy addresses for use.
- This Agreement was developed by the Administration and contains the basic norms and rules under which services are provided and access to the Internet Service is made available.
- The set of software of the Internet Service is intended to provide the User with the ability to place an order for services from the Administration and consume these services in accordance with the formed and paid order.
- The Administration reserves the right to make changes to the text of this Agreement, notifying Users of such changes by publishing a new version of the Agreement and informing Users about it. The User is obligated to regularly monitor any changes made to the text of this Agreement. If the User does not agree with the new version of the Agreement, the User must immediately cease using the Internet Service (its services). If, after the new version of the Agreement comes into effect, the User continues to use the Internet Service (its services), the User thereby confirms their full acceptance of the new version of the Agreement.
- The User is obligated to fully familiarize themselves with the Agreement before completing the registration process. Use of the Internet Service means the User’s full and unconditional acceptance of this Agreement in accordance with the applicable laws.

Acceptance of the Agreement.
- In order to use the functional capabilities of the Internet Service and the services provided by the Administration, the User must accept this Agreement.
- To use the functionalities of the Internet Service and the services provided by the Administration, the User must accept this Agreement.
- From a legal standpoint, the acceptance of this Agreement consists of the User’s legal actions aimed at completing the registration process in the Internet Service. Such actions include the provision of personal data by the User to the Administration for the purpose of establishing contractual relations under the terms of this Agreement.
- The User is prohibited from using the functional capabilities of the Internet Service without full and unconditional acceptance of the terms of this Agreement.
- All electronic documents, notifications, and declarations made or carried out remotely, through the Internet Service and within the framework of this Agreement, are considered executed in proper written form.
- The acceptance period of this Agreement is not limited or is set individually.

Registration.
- A mandatory condition for the start of using the Internet Service and proxy address rental services is the completion of the registration procedure by the User.
- The registration procedure is carried out by the User by providing the Administration with personal data (including email address) according to the registration form, which is published at the address – panel.proxystores.com/register.
- After completing the registration procedure, the User will receive a message to the email address provided by the User during registration on the Internet Service. In the message, the Administration will notify the User of the registration fact and assign the status of a User of the Internet Service to the individual. Additionally, the message will include the initial login password for the User.
- To authenticate in the Internet Service, the User must enter their email address and the password provided by the Administration in the message into the corresponding fields. Authentication in the Internet Service is carried out at the following address: panel.proxystores.com/login.

Personal Account.
- After completing the registration process and assigning the legal status of a registered User of the Internet Service, the Administration provides such a User with access to their personal account.
- The personal account is designed for replenishing the user’s balance, familiarizing with the list and cost of services provided by the Administration within the framework of the Internet Service, placing and paying for orders, statistical control, and management of proxy addresses provided to the user. Additionally, it allows for other actions as provided by the functionality of the personal account.
- The user confirms that any actions taken by the user within the personal account are considered actions of the user themselves.
- The user is prohibited from providing access to their personal account to other individuals.

The order placement procedure
- In order to place an order, the User must first top up their personal balance within the Internet Service. The personal balance can be replenished using any of the methods available in the User’s personal account.
- If the User’s personal balance in the Internet Service has sufficient funds, the amount of which is displayed in the User’s personal account, the User has the option to select the desired services and place an order and make a payment.
- The fact of placing an order and making a payment is displayed in the User’s personal account.
- The parties agree that if, within 3 days from the completion of the services for a specific order, the User does not send a complaint to the Administration about the improper provision of services, the services shall be considered properly provided by the Administration, and the User accepts them in full and without any claims.

Rights and Obligations of the Administration.
- The Administration acts on behalf of the Internet Service and the ultimate beneficiaries of the Internet Service, within the framework of this Agreement and other documents that regulate the functioning of the Internet Service and Software tools.
- The Administration monitors the operation of the Internet Service, its functionality, as well as the actions of Users during the use of the Internet Service and the services provided by the Administration.
- The Administration reserves the right to restrict the User’s access to the Internet Service if such Users (in the Administration’s opinion) violate the terms and requirements of this Agreement, as well as other documents that govern the use of the Internet Service.
- The Administration has the right to:
- The Administration has the right to: change the design of the Internet Service, its content, the list of services, modify or supplement the software used or stored in the Internet Service, and other objects, including server applications, at any time with or without prior notice.
- If necessary, send Users messages related to the use of the Internet Service and its services via email and other available methods.
- Modify the terms of service provided by the Administration based on the orders of the Users.
- Reject user orders for services if, in the Administration’s opinion, such orders are related to the unlawful use of the Administration’s services and/or if the user’s actions violate the Service Rules.
- Provide the user with paid and free services, the procedure for which is described in this Agreement, as well as other documents that regulate the relationship between the Administration and the Users.
- request consent from the User at any time and in any form for the processing of personal and other data;
- Import and store personal data to which the User has been granted access.
- Impose additional restrictions on the use of the Internet Service and modify such restrictions at any time.
- Perform other actions aimed at improving the quality and convenience of using the Internet Service by Users.
- The Administration agrees to:
Provide the User with services related to proxy address rentals and other services based on the User’s orders and within the terms of this Agreement.
- The list of rights of the Administration of the Internet Service, regulated by section 6.4 of this Agreement, is not exhaustive.

Rights and obligations of the User.
- A person who has completed the registration process and uses the Internet Service within the provided functionality is recognized as a User, to whom the list of rights and obligations specified in this Agreement and other documents published on the pages of the Internet Service applies.
- The provision of services within the Internet Service is carried out on a paid basis, the amount of which depends on the volume and specifications of the services ordered by the User.
- The User has the right:
- To place an order for services within the personal account of the Internet Service;
- to use the functional capabilities of the Internet Service;
- to demand from the Administration the compliance with the terms of this Agreement, as well as other documents that regulate the functioning of the Internet Service and the procedure for providing services;
- to send requests to the Administration regarding the functioning of the Internet Service and the procedure for providing services;
- The User undertakes to:
- The user agrees to comply with all the terms of this Agreement, as well as other documents (including the Service Rules) that regulate the operation of the Internet Service and the procedure for providing services.
- provide only truthful personal (payment) data and subsequently make necessary amendments if such personal (payment) data changes, in the manner prescribed in this Agreement, as well as other documents that regulate the relationship between the Administration and the User.
- The user agrees not to use the services provided by the Administration for illegal purposes or for purposes that may in any way harm the Internet Service and/or third parties.
- The user agrees not to use proxy addresses in ways that violate the Service Rules and this Agreement.
- The user agrees not to disclose confidential information that became known to them as a result of their relationship with the Administration and the use of the Internet Service.
- not perform actions prohibited by the Agreement within the Internet Service and proxy addresses that are transferred for use to the User;
- The user agrees not to violate the generally accepted policy of citation, copying, and distribution of content in the Internet.
- familiarize themselves with the contents of this Agreement and other rules governing the provision of services by the Administration and the use of the Internet Service at least once every 2 (two) months;
- The user is prohibited from the following when using the Internet Service and its services:
- To use the Internet Service and its services in any way that may disrupt the normal functioning of the Internet Service;
- upload, store, publish, distribute and provide access to or otherwise use viruses and other malicious programs;
- take actions aimed at destabilizing the functioning of the Internet Service, attempt unauthorized access to manage the Internet Service, as well as perform any other similar actions;
- collect and/or store personal (payment) data of Users for commercial purposes. In particular, collect email addresses or other contact information of Users by automated or other means, including for the purpose of unauthorized mailing (spam) or competition;
- use automated scripts (programs) to collect information and/or interact with the Internet Service;
- in any way, including by hacking, attempt to gain access to someone else’s account (user profile) against the will of the User to whom it belongs;
- The User can delete their account, while understanding that a deleted account cannot be restored.
- The list of obligations and restrictions of the User, regulated by clauses 7.4. and 7.5. of this Agreement is not exhaustive.

Financial operations.
- Within the Internet Service, the User is provided with the opportunity to top up their personal balance. The personal balance is statistical information that records the amount of money paid to the Administration as prepayment for future services.
- The User’s personal account displays the amount of money that the User has paid to the Administration as prepayment for future services.
- The User is provided with the opportunity to place an order and pay for it from the prepayment that was transferred to the Administration and the volume of which is displayed in the User’s personal account.
- Payment is made by methods provided in the User’s personal account.
- The User’s placement of an order in the personal account is the User’s instruction to the Administration to deduct funds in the established amount from the User’s prepayment.
- Refund of money that was transferred to the Administration by the User as prepayment for future services is not subject to return, except in cases where such payment was made by the User accidentally and this is confirmed by relevant documents.

Responsibility. Disclaimer of liability.
- The Administration does not guarantee that the Internet Service is free from errors and malicious programs. The Administration is not responsible if the use of the Internet Service resulted in data loss or equipment damage.
- The Administration is not responsible for possible failures and interruptions in the operation of the Internet Service (its services) and the resulting loss of information or damages. The Administration is not responsible for any damage to the User’s mobile devices, any other equipment or software caused by or associated with the use of the Internet Service and its services.
- The Administration does not bear any responsibility or any obligations for damage caused to the User as a result of interaction with advertisements placed in the Internet Service, if they are present in the Internet Service.
- The Administration is not responsible for losses and harm caused to the user as a result of using the Internet Service and its services.
- Any trademarks, marks and names of products, services and organizations, design rights, copyrights and related rights that are mentioned, used or quoted in the Internet Service belong to their legal owners and their use here does not give the right to any other use.
- The Administration is not responsible for the accuracy of personal data provided by Users.
- For violation of the terms of this Agreement, the User’s access to the Internet Service (services) may be restricted, suspended or terminated for an indefinite period.
- The User bears material and other types of responsibility for violating the terms of this Agreement, as well as other documents that regulate the functioning of the Internet Service, in the amount of damages, losses and lost profits caused.

Confidentiality.
- The Administration guarantees the collection, processing and storage of Users’ personal data in strict accordance with the requirements of current legislation.
- The procedure for processing Users’ personal data is regulated by the Privacy Policy of the Internet Service proxystores.com, published at – proxystores.com/private-policy.

Intellectual rights.
- All objects accessible through the Internet Service, including design elements, text, graphic images, illustrations, videos, programs, databases and other objects, as well as any content posted on the pages of the Internet Service, are objects of exclusive rights of the Administration and other rights holders.
- The use of content, as well as any other elements of the Internet Service, is possible only within the functionality of the Internet Service. No elements of the Internet Service content, as well as any content posted on the pages of the Internet Service, can be used in any other way without the prior permission of the rights holder. Use includes, but is not limited to: reproduction, copying, processing, distribution on any basis, display, etc. Exceptions are cases expressly provided for by legislation or the terms of use of a particular functionality.
- The User’s use of elements of the Internet Service content, as well as any content for personal non-commercial use, is permitted subject to the preservation of all copyright notices, related rights, trademarks, other authorship notices, preservation of the name (or pseudonym) of the author/name of the rights holder in unaltered form, preservation of the corresponding object in unaltered form. Exceptions are cases expressly provided for by legislation or other documents that regulate the functioning of the Internet Service.

Force majeure.
- The Administration is released from liability for partial or complete non-fulfillment of obligations under this Agreement if such non-fulfillment was the result of force majeure circumstances that arose after the publication of this Agreement as a result of force majeure circumstances that the parties could not foresee or prevent.
- The parties consider force majeure events to be events that make it impossible for the respective party to fulfill its obligations under the contract: earthquakes, floods, other natural disasters, fires, nuclear and other industrial accidents, as well as strikes, military actions, civil unrest or acts of state bodies that prevent the fulfillment of the Agreement’s conditions. All other obstacles, regardless of their nature or characteristics, are not considered force majeure, except for those obstacles that will be specifically recognized by the parties as caused by force majeure circumstances.
- Also, force majeure circumstances include situations when non-performance of financial operations by the Administration within the specified time is related to actions (inaction) of third parties, which the Administration cannot influence, including financial institutions and/or other institutions that are directly involved in conducting financial operations.

Disputes.
- This Agreement is governed and interpreted in accordance with the current legislation of the Administration’s residence.
- All disputes arising within the framework of this Agreement and other documents of the Internet Service are resolved through negotiations.
- If it is impossible to resolve the dispute through negotiations, the dispute is referred to the courts of any jurisdiction at the location of the Administration.
- The User confirms that the pre-trial settlement of disputes (claim procedure) is mandatory for disputable situations that arise between the Administration and the User. The term for considering claims is 10 (ten) working days from the moment the relevant claim is received by the respective party.

Term of validity.
- This Agreement comes into force from the moment of its acceptance by the user and remains in effect throughout the entire time the user uses the Internet Service.
- Early termination of this User Agreement is carried out by sending an appropriate notification by the user to the Administration.
- The offer of this Agreement is valid from the moment of its publication on the pages of the Internet Service and is valid for an unlimited amount of time.

Technical support.
- Within the framework of the Internet Service, Users may be provided with technical and consultation support, which is carried out based on the corresponding User request.
- In cases when a User contacts the Administration with a request outside of working hours, the Administration will respond to such User on the next working day following the User’s request. The Administration cannot guarantee the availability of free managers 24/7, therefore a delay in responding to a User’s request cannot be considered as the Administration’s failure to fulfill its obligation for technical and consultation support.
- To contact the Administration, the User can make a request using the functionality of the Software tools or by sending a request to the official email address of the Administration – admin@proxystores.com.

Final provisions.
- This Agreement applies to all relations that arise between the User and the Administration in the process of the User’s use of the Internet Service.
- This Agreement may be supplemented by documents published on the pages of the Internet Service. Such documents have legal force and can be applied to the relations between the Administration and Users similarly to this Agreement. At the same time, the norms and conditions established in this Agreement have primary legal force, and in case of contradiction between the norms of this Agreement and documents published on the pages of the Internet Service, the text of this Agreement takes precedence.
- In the event that some provisions of this Agreement are declared invalid by a court, this does not affect the remaining provisions of this Agreement, and they continue to be in effect and regulate the contractual relations between the Administration and the User.
